COMMITMENTS ON FREEDOM OF ASSOCIATION AND SPORTS NEGOTIATION IN CPTPP AND EVFTA: PERCEPTION – ANALYSIS – COMMENTARY

The right to freedom of association and collective bargaining is a group of socio-economic and cultural rights, specified in the international legal corridor, recognized and guaranteed by countries. Vietnam's participation in new generation free trade agreements opens up many opportunities in socio-economic development, but also poses many challenges, including ensuring the implementation of labor commitments as required by new generation FTAs, especially completing the legal corridor to ensure the implementation of international labor standards. The article analyzes the requirements of new generation FTAs for commitments on freedom of association and collective bargaining; the internalization of these commitments in Vietnamese labor law. Then, proposal solutions of effectively implement commitments on freedom of association and collective bargaining at the request of CPTPP and EVFTA.
