ENSURE PRINCIPLES OF LITIGATION AT THE COURT OF FIRST INJURY OF ADMINISTRATIVE CASES IN VIETNAM

The Party's policies and viewpoints on litigation principles have been institutionalized in the Constitution. In Clause 5, Article 103 of the 2013 Constitution, it is stipulated that "The principle of litigation in trial is guaranteed"[2]. Thus, for the first time, ensuring litigation in trials is recognized as a principle, representing a great step forward in our country's law-making activities. Based on the presentation and analysis of general awareness of litigation in administrative proceedings, the characteristics and role of litigation at the first instance trial of administrative cases, the author comments and offers some solutions on legal and organizational aspects to effectively implement the principles of litigation at the first instance trial of administrative cases, ensuring objectivity, fairness and democracy in the first instance trial of administrative cases in order to serve as a basis to determine the truth of the case, the basis for the Trial Council to make correct, objective and legal judgments and decisions.
