The human right to live in a healthy environment is officially recognized in Article 43 of the 2013 Constitution from the fact that the environment and ecosystem are seriously degraded in the context of our country carrying out the national renovation and international integration. Environmental degradation and pollution occur in many localities, threatening economic development, affecting health, life, and human rights. This is a new right recognized in the Constitution, becoming an important principle in the Law on Environmental Protection 2014.
After nearly 5 years of implementing the Constitution, ensuring human rights to live in a healthy environment has actually achieved certain achievements such as the promulgation of many legal documents creating a legal basis to ensure human rights. , in which the most important document is the environmental law; awareness of environmental protection has been enhanced; environmental management is more and more important; Investment funds for environmental protection have been paid attention;... However, along with the achievements, in practice, ensuring human rights to live in a healthy environment also encounters difficulties. few difficulties such as a number of legal provisions are limited, inadequate, have not yet promoted the effectiveness and feasibility,... On the basis of analysis of advantages, difficulties and limitations of the practice of assurance human right to live in a healthy environment, the article proposes a number of solutions to ensure the effective implementation of this right in practice.
